1. Agreement to Terms

By accessing or using Triagly ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Definitions

  • "Service" refers to the Triagly platform, including our website, dashboard, SDK, and APIs.
  • "User" or "you" refers to the individual or entity accessing or using the Service.
  • "Content" refers to feedback, text, images, screenshots, or other materials submitted through the Service.
  • "Account" refers to your registered account on the Service.

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

5. User Content

You retain ownership of any Content you submit through the Service. By submitting Content, you grant Triagly a worldwide, non-exclusive, royalty-free license to use, process, store, and display that Content solely for the purpose of providing and improving the Service.

You represent that you have all necessary rights to submit Content and that your Content does not violate any third-party rights or applicable laws.

We may use AI and machine learning to process your Content for classification, summarization, and analysis. This processing is performed solely to provide Service features and improve our algorithms.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Triagly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

7. Payment Terms

Some features of the Service require a paid subscription. By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your chosen plan
  • Provide accurate billing information
  • Authorize us to charge your payment method on a recurring basis

Fees are non-refundable except as required by law or as explicitly stated in our refund policy. We may change our pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance or security updates
  • Factors beyond our control (network issues, third-party services)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIAGLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Triagly and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease. You may request export of your data prior to termination.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
